Elon Musk is suing OpenAI from the position of a co-founder who says the organization drifted away from its original mission. But in court, a more uncomfortable technical issue surfaced: whether xAI learned from OpenAI models while building Grok. According to TechCrunch, Musk was asked in California federal court whether xAI used distillation techniques on OpenAI models. He first said this was a general practice in the AI industry. When the question narrowed to a direct answer, he acknowledged it: partly. Distillation in this context means one system systematically queries another model and uses its answers as a signal for training or tuning its own model. It is not copying model weights, but it is an attempt to extract behavioral clues from a more mature and expensive system.

Major labs spend enormous sums on data, chips, engineering, and evaluation. That is why OpenAI, Anthropic, and Google have a strong incentive to detect mass querying and block suspicious patterns. The boundary is messy. All models learn from some external signal, and users ask public chatbots questions every day. What makes distillation sensitive is not one conversation, but intent and scale: automated answer collection, weakness mapping, and building a competing model through another company's system. Musk's admission is therefore not only a legal footnote. It shows an AI industry in which public moral arguments often lag behind technical practice. Companies condemn distillation when it comes from outside, while market pressure pushes them to watch what competitors are doing. For users and regulators, the larger issue is this: if models are increasingly built from the outputs of other models, it becomes harder to know where capability comes from, where errors enter, and who is responsible when the same weakness is replicated across multiple products.
